Stop Deportation
 

 

Immigration and Customs Enforcement (ICE) routinely apprehends, detains, and removes individuals illegally present in the Unites States. Legal permanent residents may also be subject to removal for violation of certain laws, including conviction for certain crimes.

 

After apprehension, ICE serves the immigrant with a Notice to Appear. The immigrant can agree to leave the United States, or can fight removability. The immigrant may be kept in custody, or may be released. If the immigrant is kept in custody, a custody redetermination hearing, or bond hearing, can be requested. The minimum bond in immigration proceedings is $1,500.00.

 

Relief from removal is available in many cases and can stop the removal process. If a removal order was previously entered against an alien, ICE may proceed with removal and remove the alien from the country with no further court proceedings. The alien may be able to request a stay and stop the removal process. A motion to reopen may also stop the removal process.

 

Immigration proceedings are complex and relief from removal may be available in certain cases. Immediate consultation with an immigration attorney is strongly recommended. Failure to attend removal hearings, inability to conduct the hearings properly or ask for proper relief, failure to file proper applications, and delay in getting legal help may result in removal (deportation) from the country.

Steps to Take if Apprehended by ICE
 

 

The following suggestions are useful if an alien is apprehended by ICE or put in removal proceedings:

  • Do Not consent to removal;

  • Call an Immigration attorney immediately and discuss the case;

  • Make sure your address is current with ICE and the immigration court;

  • If the alien is in custody, ask for a bond or a bond hearing;

  • Save every document given to you and take all your immigration documents to your attorney; and

  • Discuss if a relief, such as adjustment of status, or cancellation of removal may be available;

  • Do not miss your removal hearing and make sure you attend the hearing with an immigration attorney.
